A garden suite, a laneway house, or a multiplex is a mortgage file only after the city allows the unit and the lender can read it. A drawing is not a permit. Rent from a unit that is not legal is not income.
Toronto's planning pages describe multiplex housing of two to four units on many residential lots, and garden suites on lots that qualify. North York is inside the City of Toronto, so those same pages are the starting point for a Willowdale bungalow or a lot in Don Mills. The pages checked on October 18, 2026 are multiplex housing and garden suites. A lot can still fail the setbacks, the parking, or the building code. The city decides that. We do not.
If you already live in the home, CMHC's secondary-suite refinance can fund the build. The page checked the same day says the loan can go up to 90% of the as-improved value, the value has to be below $2 million, and the property can have no more than four units including the one you live in. The extra money is for the construction. Equity take-out is not what that product is for. The suite has to be self-contained, and it cannot be a short-term rental of less than 90 days. The loan is advanced as the work proceeds, and CMHC wants the financing approved before construction starts or at an early stage. Subject to lender and insurer approval. The source is CMHC refinance for secondary suites.
Buying a house that already has a legal suite is a different file. On an owner-occupied home, CMHC's rental-income approach can use rent, up to the share that program publishes. A conventional lender may use a smaller share. We ask for the permit and the lease before the rent is counted. A basement that shares a kitchen is not this file. The longer note is buying with a separate-entrance basement.
Oakville, Milton, Brampton, Mississauga, and Vaughan have their own additional-unit rules. Those answers sit on the city hubs, not as a copy of the Toronto bylaw: North York, Toronto, Oakville, Milton, Brampton, Mississauga, and Vaughan.
